Terms of Service

These Terms of Service are an agreement between you and Tably. Please read them carefully. If you do not agree to these Terms, you must not use the Tably Service.

A. Definitions

“Tably”, “we”, “us” and “our” refer to Tably Ltd. (UK company registration number 07860821, VAT number GB385649249, office address Tably Ltd., 1 Mark Square, London EC2A 4EG) as well as our affiliates, directors, subsidiaries, contractors, licensors, officers, agents, and employees.

“The User”, “you” and “your” refer to the individual person, company, or organisation that has visited or is using the Service; or that directs the use of the Service in the performance of its functions. A User must be at least 13 years of age.

The “Service” refers to Tably’s website located at tably.com, APIs located at api.tably.com, applications, software, products, and services provided by Tably.

The “Terms” refers, collectively, to all the terms, conditions, notices contained or referenced in this document.

B. Access to our Service

  1. We permit access to our Service to you on a temporary basis, and we reserve the right to withdraw your access or amend the content we provide on our Service without notice. We will not be liable if for any reason our Service and content is unavailable at any time or for any period.

  2. From time to time, we may restrict access to some parts of our Service, or our entire Service.

  3. We will only use your personal information as set out in our Privacy Policy. You agree to be bound by our Privacy Policy, which is incorporated into these Terms.

  4. Certain areas of the Service may be restricted to account holders only. If you create an account, you must treat such account information, including your password, as confidential and must not disclose it to any third party. You must promptly notify us if you suspect anyone else has obtained access to your account.

  5. Your right to access and use the Service will be terminated immediately if you breach any of these Terms.

  6. You agree that we may reference you as our customer, subject to your provided trademark and logo usage guidelines, and that occasionally, after your review, we may issue a press release and case study.

  1. We are the owner or the licensee of all intellectual property rights in our Service, and in the material published on it. Those works are subject to copyright and are protected by worldwide intellectual property laws. All such rights are reserved.

D. Information on this Service

  1. The content on our Service (including any links to other sites and resources) is provided “as is” for general information only. It is not intended to amount to advice on which you should rely.

  2. Although we make reasonable efforts to update the information on our Service, we make no representations, warranties or guarantees, whether express or implied, that the content on our Service is accurate, complete or up to date.

  3. We are not responsible for any content which is not published by us and have no control over content of any third party sites or resources linked to our Service.

E. User-generated content

  1. Our Service may include information and materials uploaded by other users of the Service. This information and these materials have not been verified or approved by us. The views expressed by other users on our Service do not represent our views or values.

F. Conduct of users

  1. You acknowledge that you are solely responsible for interactions with other users of this Service (if any), and that you are solely responsible for all content you publish or post to this Service or transmit to other users of this Service.

  2. You agree not to post, distribute or reproduce in any way any copyright material, trademarks or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.

  3. You will not submit any content that contains offensive, obscene or otherwise unlawful references, offensive language, or other material that we may consider could bring us or the Service into disrepute.

  4. You agree not to misuse our Service, for example, by interfering with it or accessing it using a method other than the interface and the instructions that we provide. You agree that you will not work around any technical limitations in the software provided to you as part of the Service, or reverse engineer, decompile or disassemble the software, except and only to the extent that applicable law expressly permits.

  5. You agree not to transmit spam or viruses to other users, and not to participate in mischievous or malicious behaviour which causes damage or may cause damage to us or this Service or any of the computer systems on which this Service resides.

  6. You must not attempt to gain unauthorised access to this Service, the servers on which this Service is stored or any server, computer or database connected to this Service. You must not attack this Service via a denial-of-service attack.

G. Our responsibility for loss or damage suffered by you

  1. Nothing in these Terms excludes or limits our liability to you for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation and where it would otherwise be unlawful to do so.

Subject to the foregoing, we exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it and will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

    2. use of or reliance on any content displayed on our Service.

  3. In particular, we will not be liable for loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

  4. We do not guarantee that our Service will be secure or free from bugs or viruses.

H. Changes to the Service and these terms

We may update and change our Service from time to time to reflect changes to our services, our users’ needs, changes in the law, regulatory requirements and our business priorities, which may also require changes to these Terms. Every time you wish to use this Service, please check these Terms to ensure you understand the terms that apply at that time.

I. Applicable law

  1. These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
